These terms govern your use of AV Mobile Notary services and website. Please read them carefully.

1. Acceptance of Terms

By accessing or using the services provided by AV Mobile Notary ("we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and AV Mobile Notary.

If you do not agree to these Terms, you may not use our services or website. These Terms are governed by California state law and comply with all applicable California regulations for notary public services.

2. Services Description

AV Mobile Notary provides mobile notary public services throughout Orange County, Los Angeles, and the Inland Empire. Our services include:

  • Document notarization and acknowledgments
  • Jurat services and oath administration
  • Copy certification of documents
  • Signature witnessing
  • Mobile notary services at your location
  • Loan signing services

All services are performed in accordance with California Government Code Sections 8200-8230 and other applicable California notary laws and regulations.

3. Client Responsibilities

As a client of AV Mobile Notary, you agree to:

  • Provide valid, government-issued photo identification
  • Appear personally before the notary for all notarizations
  • Provide complete and accurate information
  • Pay all fees as agreed upon prior to service
  • Ensure documents are complete and ready for notarization
  • Comply with all applicable laws and regulations
  • Not request any illegal or improper notarial acts

Document Requirements

You acknowledge that:

  • Documents must be complete before notarization
  • Blank or incomplete documents cannot be notarized
  • You understand the contents of documents being notarized
  • You are signing voluntarily and without coercion

4. Fees and Payment

Our fees are established in accordance with California Government Code Section 8211 and include:

  • Notarial fees as permitted by California law
  • Travel fees for mobile services
  • Additional fees for after-hours or emergency services
  • Loan signing fees as separately agreed

Payment Terms

  • Payment is due at the time of service unless otherwise arranged
  • We accept cash, check, and electronic payments
  • Returned checks will incur additional fees as permitted by law
  • Cancellation fees may apply for last-minute cancellations

5. Limitations and Disclaimers

Notary Limitations

As a California notary public, we cannot:

  • Provide legal advice or explain document contents
  • Choose the type of notarization for you
  • Notarize incomplete documents
  • Notarize documents without proper identification
  • Notarize for individuals who cannot communicate directly
  • Certify copies of vital records or public documents

Service Disclaimers

AV Mobile Notary disclaims responsibility for:

  • The legal effect or validity of documents notarized
  • The accuracy or completeness of document contents
  • Legal consequences arising from notarized documents
  • Delays due to traffic, weather, or other circumstances beyond our control

6. Liability and Insurance

AV Mobile Notary maintains errors and omissions insurance and a surety bond as required by California Government Code Section 8212. Our liability is limited to the amount of our surety bond ($15,000) and insurance coverage.

Limitation of Liability

To the maximum extent permitted by California law:

  • Our total liability shall not exceed the fees paid for services
  • We are not liable for indirect, consequential, or punitive damages
  • Claims must be brought within one year of the notarial act
  • You agree to indemnify us against claims arising from your misuse of notarized documents

7. Privacy and Confidentiality

We are committed to protecting your privacy and maintaining the confidentiality of your personal information and documents. Our privacy practices are detailed in our Privacy Policy, which is incorporated by reference into these Terms.

Record Keeping

In accordance with California Government Code Section 8206, we maintain:

  • A sequential journal of all notarial acts
  • Records for a minimum of 10 years
  • Secure storage of all notarial records
  • Compliance with all record-keeping requirements

8. Cancellation and Rescheduling

Client Cancellations

  • Cancellations with 2+ hours notice: No fee
  • Cancellations with less than 2 hours notice: $50 fee
  • No-show appointments: Full travel fee applies

Our Cancellations

We may cancel or reschedule appointments due to:

  • Emergency situations or illness
  • Unsafe travel conditions
  • Legal or ethical conflicts
  • Client non-compliance with requirements

9. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

Governing Law

These Terms are governed by California state law, without regard to conflict of law principles. Any legal action must be brought in the appropriate courts of California.

Alternative Dispute Resolution

Before pursuing legal action, parties agree to attempt resolution through:

  • Direct negotiation between the parties
  • Mediation through a mutually agreed mediator
  • Binding arbitration if mediation fails

10. Compliance and Regulatory Information

California Notary Commission

AV Mobile Notary operates under a valid California notary public commission issued by the California Secretary of State. Our commission information is available upon request.

Regulatory Compliance

We comply with all applicable California laws and regulations, including:

  • California Government Code Sections 8200-8230
  • California Code of Regulations Title 2, Division 3
  • California Consumer Privacy Act (CCPA)
  • California Unruh Civil Rights Act
  • Americans with Disabilities Act (ADA)

11. Modifications and Updates

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Material changes will be communicated to clients with active service agreements.

Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.
